 Elder Law

Elder Law is an umbrella term for the range of legal issues that arise as we age. Since 1983, we’ve made elder law a key part of our legal practice.

We provide a full range of elder law services and expert advice in the following areas:

  • Will-making.

  • Enduring powers of attorney.

  • Occupation right agreements.

  • Welfare guardianship matters (including litigation).

  • Advance care directives.

  • End of Life Choice Act (‘right to die’) matters.

  • Estate administration.

We offer a special discount for Super Gold cardholders and Grey Power members.

 Family Law

Families can be complicated. We provide our clients with clear and concise advice on matters like property division, child support, and marriage dissolution.

We aim to resolve matters amicably and without going to court. However, should the need arise, we’ll expertly help you navigate Family Court.

Waikanae Law can help you with:

  • Contracting out agreements ( ‘pre-nuptial agreements’).

  • Separation.

  • The division of relationship property.

  • Financial support, including child support entitlements and disputes.

  • Marriage dissolution (divorce).

 Wills & Estates

We can’t overstate the importance of having a professionally-drafted will that properly records your wishes and considers the law’s restrictions on what you can (and can’t) do with your property. We provide our will-making expertise to clients for a fixed fee. We provide peace of mind, value for money, and ensure that you've considered everything you need to.

Estate administration can be fraught. Waikanae Law will make the process of applying for probate or letters of administration straightforward. We ensure we are available to answer questions and to guide your family and friends through the process.

We assist clients with:

  • Will-making.

  • Applications for probate or letters of administration.

  • Dispute resolution.

 Criminal Law

Waikanae Law provides high-quality advice and skilled representation on traffic and criminal matters. If you've been charged with an offence or an infringement and need advice, we can help.

Waikanae Law can assist you with most traffic and criminal matters, such as:

  • All District Court criminal matters.

  • Traffic offences, such as drink driving, careless and dangerous driving.

  • Obtaining a limited driver’s licence following disqualification.

We help our clients navigate the courts system, ensuring that our approach is tailored to the particular needs of your case. We are outcome focused, and will clearly explain your rights and be clear about your options.

We are available to appear in the Wellington, Porirua, Lower Hutt and Levin Courts.

 Powers of Attorney

An enduring power of attorney allows you to appoint someone to manage your personal and property affairs.

You can appoint an attorney to act for you in relation to property matters, and/or in relation to personal care and welfare. Often these are done at the same time. You have some options as to when an enduring power of attorney for property will come into effect, whereas an enduring power of attorney for personal care and welfare will only come into effect in the event that you lose capacity.

Attorneys have certain responsibilities and it is crucial to choose a person or persons you can trust, but also someone who has the right skills and abilities to deal with matters that may arise. It's also important to get proper legal advice about the nature and effect of your enduring powers of attorney.

We prepare enduring powers of attorney for a fixed fee, and can do so in conjunction with your will, or separately.

 Commercial Law

Waikanae Law can assist you with general commercial matters. We act for a range of commercial clients, from sole-traders to small-to-medium enterprises. We take the time to understand our clients and their businesses. We understand that you know your business best, but might need some help with the law.

We’ll be responsive, tell you what you need to know, and do what you need us to - when you need us to. Waikanae Law can help you with:

  • Commercial leasing.

  • Business sales and purchases.

  • Franchise agreements.

  • Employment law.

  • Debt collection.

  • Consumer and fair trading matters.
