Our fees for preparing your will are set out below. Many of our clients also wish to have enduring powers of attorney prepared at the same time, in which case we offer a special combined fee.
Standard will: $280 (incl. GST)
Covers situations where your estate is to be divided equally among family members and there are no complicating factors – such as stepchildren, businesses, trusts or overseas assets.
Complex will: $450 (incl. GST)
Covers situations that are inherently more complex – such as blended families, or for those who want assets to be divided unequally between family members and others. It also covers most situations involving trusts, overseas assets and businesses.
Estate Administration Whether you've appointed a Waikanae Law solicitor as your executor, or a trusted friend or family member, Waikanae Law will make the process of applying for probate (or letters of administration) straightforward. We're available to executors at any time to answer questions and guide your family and friends through the process.
We will promptly discuss your estate with your executor(s), determine where and how your assets are held and identify the potential for claims to be made against your estate. Once we have the information we need, we will prepare and execute the documents required to apply to the High Court for probate or letters of administration.
Our fee for a typical application for probate or letters of administration is as follows:
Application for grant of probate or letters of administration: $2550 (incl. GST)
This fee covers the straightforward administration of an estate. In the event that administration proves complex, or requires additional work, this will be charged at a different rate. Your solicitor will advise you if this is the case and of the expected fee for such work.

Will-making Unless you have minimal assets and no close family, we believe that everyone should have a professionally-drafted will. Professional advice is relatively inexpensive and provides peace of mind that your wishes will be followed.
It may come as a surprise, but the law does not allow you to do absolutely anything you like in your will. There is a 'moral duty' to provide for close family members in your will, the potential for promises you have made during your lifetime to form the basis of a claim against your estate, as well as the possible complication of family law matters to consider.
